Habitacion certificate

Could someone please advise me, when, on selling a house, does the seller need to get the Habitacion Certificate or is it up to the buyer ?
I've been told on good authority, by Presidents of different Urbanisations, that it's the seller and that it's the buyer, so i'm not sure who is right.
I know that some unscrupulous Estate Agents charge both, therefore making a nice profit.

Unfortunately, when you sell you have to have a up to date Habitation Certificate. If you have done nothing to your house, you should have no problem. It is to prove that no alterations have been done while you have owned it. The buyer also has to get a Habitation Certificate, which is just so his name will be on the new contracts for electric and water. You can get the certificate yourself. The Town Hall will give you a form. Fill it in and go to a bank and pay the fee, which is 50€. Take the receipt back to the Town Hall and it will be processed. If any work has been done to the house, you will need the drawings and new deeds etc. An architect will then come to check the house. If all is OK, you will get your new certificate.
